The law protects public and private employees, with an employer with at least 15 employees. This includes: full-time workers, part-time, temporary, seasonal workers and job applicants.

What protections does the Pregnant Workers Fairness Act provide?

The PWFA guarantees that workers receive reasonable accommodations for limitations stemming from pregnancy, childbirth, and related medical conditions (unless the accommodation would pose an undue hardship for the employer.

Who will enforce the Pregnant Workers Fairness Act?

The US Equal Employment Opportunity Commission and the US Attorney General’s Office will enforce the PWFA. Additional guidance providing examples of reasonable accommodations for pregnant workers will be issued within the next two years.

What remedies are available under the Pregnant Workers Fairness Act?

The remedies and procedures available under Title VII apply to the PWFA.

Are any particular workers excluded from the Pregnant Workers Fairness Act?
